Several years into his career, Tony
was speaking with a client prior to a scheduled trial in a hotly
contested case. In the conversation, Tony was attempting to ascertain
from the client what he wanted out of his lawsuit, in other words, what
would make him happy. When a client is in a lawsuit, it is important
that the client be realistic about the potential outcomes; the law can
only do so much, and many times what a client truly wants, the law
cannot provide. As a professional, it is the lawyer’s job to manage
expectations and to guide the client through the difficult process.
During that conversation, Tony posed the question: “What do you hope to
gain from this case? What is it that would make you happy?” The client’s
